  2018 Contest Rules

 

These contest rules are specific to the above contest conducted by Entercom Madison, LLC d/b/a 105.5 WMMM (“Station”).  Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well.  A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 7601 Ganser Way, Madison, WI 53719 during regular business hours and on the Station’s website at www.1055triplem.com/rules. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this contest.

How to Enter and How to Win:

 

  1. No purchase necessary to enter or win the “Project M: 10th Anniversary” contest (the “Contest”).
  2. For the purposes of this Contest, the term “Entrant” means any group of one (1), two (2), or group of three (3) individuals that compose, write, sing and perform all of their own original music, all of whom must be 18 years of age or older as of the date of entry, and reside within 110 miles of the WMMM Station office at 7601 Ganser Way, Madison, WI as of the date of entry.
  3. For the purposes of this Contest, the term “Entrant” shall refer to each, or all of, the individuals comprising the eligible “Entrant” (as defined above), jointly and severally.
  4. Eligible contestants can enter this Contest from 12:00 a.m. (CT) on March 12, 2018 through March 25, 2018 at 11:59 p.m. (CT) by submitting the following material through www.1055triplem.com and clicking on the Project M Contest link: (i) submit one (1) photo of all Entrants participating; (ii) one (1) mp3 of Entrants performing one song, up to four (4) minutes in length (only the first four (4) minutes of any mp3 will be judged; however, longer mp3s will not be disqualified); and (iii) provide the following information: Entrant’s full name, address, phone number (including area code), cell phone number – if applicable (including area code), and e-mail address.
    1. Station is conducting this contest using proprietary software owned by a third party known as Second Street Media, Inc. (“Second Street”).  The entry/registration process will require you to either log into an existing account, or create a free account with the game administrator, Second Street.  You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s name, address, phone number and e-mail address.
    2. As part of the entry process, Entrants may be provided with an opportunity to opt-in to receive solicitations from, and/or to become a member/participate in clubs of (i.e., email clubs, text clubs, and rewards programs), the Station; provided, however, agreeing to receive such solicitations and/or accepting such membership is not a condition of entry into this contest and will not increase your chances of winning.
  5. MP3 Requirements: 
    1. An mp3 of the Entrant performing one (1) song, up to four (4) minutes in total length (only the first four (4) minutes of any mp3 will be judged; however, longer mp3s will not be disqualified) that is fully composed, written, sung and performed by the Entrant named on the entry form. 
    2. Performances on mp3 can be either live or studio produced (determination of this criteria will be made in Station’s sole discretion).
    3. Only one (1) song is permitted per entry submission (entries exceeding one song will be automatically disqualified). Entry forms must be legible and contain all information required. Only one entry per Entrant(s) will be permitted. No other person besides Entrant(s) can be depicted audibly on mp3.
    4. Both the music and lyrics must be fully performed by the Entrants. No sampling or recorded music may be included unless the music was wholly created by the Entrant and musical performances actually performed by only Entrants in this contest.
    5. The song MUST NOT contain any copyrighted music, lyrics or other material.  Entries containing any copyrighted material will be automatically disqualified, unless all of the writers and performers of that music are among the Entrants.  A song that includes (or is suspected to include, in Station’s sole discretion) any copyrighted lyrics or music or any pre-recorded music performed by anyone other than the Entrant (in whole or in part) will result in disqualification from this contest.
    6. Station reserves the right to disqualify and/or edit, but is not obligated to edit (as Station determines in its sole discretion on a case by case basis), any song that contains any indecency, profanity, obscenity, explicit sexuality, or lyrics that are harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, libelous, that encourages unlawful behavior, is hateful, or which is racially, ethnically or otherwise offensive or objectionable, as determined by Station in its sole discretion.  Station is not required to make the same determination based on the foregoing for every song entered (it may treat different songs differently, in its sole discretion, even if the problematic word(s) are similar).
    7. Songs and band names must not include brand names, trade-marks, trade names, logos or the intellectual property of any third parties.
    8. MP3 must be submitted via link to Soundcloud, Dropbox, Google Drive, or other cloud uploading service where the mp3 can be downloaded by WMMM for review.

 

  1. Failure to submit all of these items as requested will result in immediate disqualification.

 

  1. On or about March 26, 2018 all eligible entries will be judged by the Station judges.  Station judges will judge entries in their sole discretion based on any lawful criteria, including but not limited to singing ability, musical composition and/or overall style (“Finalist Judging Criteria”). Judges will select up to eight (8) entries to move forward in the Contest, upon confirmation of eligibility and compliance with these Contest rules (each a “Finalist” and collectively, the “Finalists”). All Finalists will be determined by the panel of judges in their sole and complete discretion and all decisions of the judges shall be final. 
    1. For the purposes of this contest, “Finalist(s)” may refer to each, any, or all of the individuals comprising the eligible Entrants, jointly and severally, associated with each entry selected by the panel of judges, jointly and severally.
    2. The Station retains the right to cancel the Contest if less than a minimum of eight (8) entries are received.
  2. Finalists will be contacted on or about March 27, 2018 by 5:00 p.m. (CT).  Finalists MUST confirm participation with a member of the Station’s promotions staff by March 29, 2018 by 5:00 p.m. (CT).  Failure to confirm will result in disqualification.  Finalists must read, complete and sign the release form included as Attachment A to these rules “as is”, and present the completed and signed form to Station staff/management upon arriving for Challenge 1 (described below). 
    1. If one or more Finalists fail to confirm participation by March 29, 2018 at 5:00 p.m. (CT), Station reserves the right to select alternate Finalists from the pool of entries based on the Finalist Judging Criteria described above. 
    2. However, alternate Finalists must confirm their participation in the Contest no later than March 30, 2018 at 5:00 p.m. (CT). The station retains the right to cancel the Contest if less than a minimum of eight (8) entries are received.

 

  1. Challenges:

 

  1. Challenge 1:
    1. On April 2, 2018, Finalists must appear in person at the Station’s studios located at 7601 Ganser Way, Madison, WI 53719 (or at another location that will be communicated to the Finalists at least 24 hours in advance) at 6:00 p.m. (CT) for up to a two (2) hour period and will each be given Challenge 1.  Finalists will be given seven days to prepare for Challenge 1. On April 2, 2018 Finalists’ order of performance for Challenge 1, which occurs on April 9, 2018 will be randomly selected. Eight (8) Finalists will complete Challenge 1 on same day.
    2. On April 9, 2018, Finalists must appear in person at Funk’s Pub located at 5956 Executive Drive #101, Fitchburg, WI 53719 at 6:00 p.m. (CT) for up to a six (6) hour period to complete Challenge 1.
    3. Finalists will each be given Challenge 2 once they have completed Challenge 1, but only remaining Finalists will be able to complete Challenge 2.
    4. Each Finalist’s completed Challenge 1 will be videotaped and posted online at www.1055triplem.com.  Videos will be posted by the end of the business day (5:00 p.m. CT) on April 11, 2018 and listeners will be asked to vote for the Finalist they think the Station judges should select to remain in the contest. Listeners may vote online by going to www.1055triplem.com and clicking on the Project M link and clicking on the Project M poll. Listener voting begins after videos are posted and ends on April 15, 2018 at 12:00 p.m. (CT). Notwithstanding the foregoing, Station reserves the right at any time to end online voting prior to the announced closing date for voting, for any reason or for no reason, by providing notice on-air and online.  Listeners may vote as often as they want.  Listener votes will be taken into consideration in the selection of the Finalists by the judges, but listener votes will not be the determinative factor of the selection of the Finalists.
    5. Upon close of listener voting, a panel of Station judges will decide which Finalist(s) is the winner(s) of that particular challenge and which Finalist(s) will be eliminated from the Contest, based on any lawful criteria they determine in their sole discretion, including but not limited to listener votes. 
    6. Station will announce the Finalist(s) who won that particular challenge, subject to confirmation of eligibility and compliance with the Contest rules) and the Finalist(s) who has been eliminated from the Contest on April 16, 2018 prior to the Finalist completion of Challenge 2.  The eliminated Finalist(s) will not be eligible to compete in Challenge 2.

 

  1. Challenge 2:
    1. On April 16, 2018, remaining Finalists from Challenge 1 must appear in at Funk’s Pub located at 5956 Executive Drive #101, Fitchburg, WI 53719 at 6:00 p.m. (CT) for up to a 6 hour period to complete Challenge 2. Finalists will be given seven days to prepare for Challenge 2. On April 9, 2018 Finalists’ order of performance for Challenge 2, which occurs on April 23, 2018 will be randomly selected. Seven (7) Finalists will complete Challenge 2 on same day.
    2. Remaining Finalists after the results are announced for Challenge 1 on April 16, 2018 will each be given Challenge 3, but only non-eliminated Finalists will be able to participate in Challenge 3 on April 23, 2018.
    3. Each remaining Finalist’s completed Challenge 2 will be videotaped and posted online at www.1055triplem.com.  Videos will be posted by the end of the business day (5:00 p.m. CT) on April 18, 2018 and listeners will be asked to vote for the Finalist they think the Station judges should select to remain in the contest. Listeners may vote online by going to www.1055triplem.com and clicking on the Project M link and clicking on the Project M poll. Listener voting begins after videos are posted and ends on April 22, 2018 at 12:00 p.m. (CT). Notwithstanding the foregoing, Station reserves the right at any time to end online voting prior to the announced closing date for voting, for any reason or for no reason, by providing notice on-air and online.  Listeners may vote as often as they want. Listener votes will be taken into consideration in the selection of the Finalists by the judges, but listener votes will not be the determinative factor of the selection of the Finalists.  
    4. Upon close of listener voting, a panel of Station judges will decide which Finalist(s) is the winner(s) of that particular challenge and which Finalist(s) will be eliminated from the Contest, based on any lawful criteria they determine in their sole discretion, including but not limited to listener votes. 
    5. Station will announce the Finalist(s) who won that particular challenge, subject to confirmation of eligibility and compliance with the Contest rules) and the Finalist(s) who has been eliminated from the Contest on April 16, 2018 prior to the Finalists completion of Challenge 3. The eliminated Finalist(s) will not be eligible to compete in Challenge 3. 

 

  1. Challenge 3:
    1. On April 23, 2018, remaining Finalists from Challenge 2 must appear in at Funk’s Pub located at 5956 Executive Drive #101, Fitchburg, WI 53719 at 6:00 p.m. (CT) for up to a 6 hour period to complete Challenge 3.  Finalists will be given seven days to prepare for Challenge 3. On April 16, 2018 Finalists’ order of performance for Challenge 3, which occurs on April 23, 2018 will be randomly selected. Six (6) Finalists will complete Challenge 3 on same day.
    2. Remaining Finalists after the results are announced for Challenge 2 on April 23, 2018 will each be given Challenge 4, but only non-eliminated Finalists will be able to participate in Challenge 4 on April 30, 2018.
    3. Each remaining Finalist’s completed Challenge 3 will be videotaped and posted online at www.1055triplem.com.  Videos will be posted by the end of the business day (5:00 p.m. CT) on April 25, 2018 and listeners will be asked to vote for the Finalist they think the Station judges should select to remain in the contest. Listeners may vote online by going to www.1055triplem.com and clicking on the Project M link and clicking on the Project M poll. Listener voting begins after videos are posted and ends on April 29, 2018 at 12:00 p.m. (CT). Notwithstanding the foregoing, Station reserves the right at any time to end online voting prior to the announced closing date for voting, for any reason or for no reason, by providing notice on-air and online.  Listeners may vote as often as they want. Listener votes will be taken into consideration in the selection of the Finalists by the judges, but listener votes will not be the determinative factor of the selection of the Finalists.  
    4. Upon close of listener voting, a panel of Station judges will decide which Finalist(s) is the winner(s) of that particular challenge and which Finalist(s) will be eliminated from the Contest, based on any lawful criteria they determine in their sole discretion, including but not limited to listener votes. 
    5. Station will announce the Finalist(s) who won that particular challenge, subject to confirmation of eligibility and compliance with the Contest rules) and the Finalist(s) who has been eliminated from the Contest on April 23, 2018 prior to the Finalists completion of Challenge 4. The eliminated Finalist(s) will not be eligible to compete in Challenge 4. 

 

  1. Challenge 4:
    1. On April 30, 2018, remaining Finalists from Challenge 3 must appear in at Funk’s Pub located at 5956 Executive Drive #101, Fitchburg, WI 53719 at 6:00 p.m. (CT) for up to a six (6) hour period to complete Challenge 4. Finalists will be given seven days to prepare for Challenge 4. On April 23, 2018 Finalists’ order of performance for Challenge 4, which occurs on April 30, 2018 will be randomly selected. Five (5) Finalists will complete Challenge 4 on same day.
    2. Remaining Finalists after the results are announced for Challenge 3 on April 30, 2018 will each be given Challenge 5, but only non-eliminated Finalists will be able to participate in Challenge 5 on May 7, 2018.
    3. Each remaining Finalist’s completed Challenge 4 will be videotaped and posted online at www.1055triplem.com.  Videos will be posted by the end of the business day (5:00 p.m. CT) on May 2, 2018 and listeners will be asked to vote for the Finalist they think the Station judges should select to remain in the contest. Listeners may vote online by going to www.1055triplem.com and clicking on the Project M link and clicking on the Project M poll. Listener voting begins after videos are posted and ends on May 6. 2018 at 12:00 p.m. (CT). Notwithstanding the foregoing, Station reserves the right at any time to end online voting prior to the announced closing date for voting, for any reason or for no reason, by providing notice on-air and online.  Listeners may vote as often as they want. Listener votes will be taken into consideration in the selection of the Finalists by the judges, but listener votes will not be the determinative factor of the selection of the Finalists.  
    4. Upon close of listener voting, a panel of Station judges will decide which Finalist(s) is the winner(s) of that particular challenge and which Finalist(s) will be eliminated from the Contest, based on any lawful criteria they determine in their sole discretion, including but not limited to listener votes. 
    5. Station will announce the Finalist(s) who won that particular challenge, subject to confirmation of eligibility and compliance with the Contest rules) and the Finalist(s) who has been eliminated from the Contest on April 30, 2018 prior to the Finalists completion of Challenge 5. The eliminated Finalist(s) will not be eligible to compete in Challenge 5. 

 

  1. Challenge 5:
    1. On May 7, 2018 remaining Finalists from Challenge 4 must appear in person at Funk’s Pub located at 5956 Executive Drive #101, Fitchburg, WI 53719 at 6:00 p.m. (CT) for up to a six (6) hour period to complete Challenge 5.  Finalists will be given seven days to prepare for Challenge 5. On April 30, 2018, Finalists’ order of performance for Challenge 5, which occurs on May 7, 2018, will be randomly selected. Four (4) Finalists will complete Challenge 5 on same day.
    2. Upon the conclusion of each remaining Finalist’s performance at Challenge 5, a panel of Station judges will decide which remaining Finalist(s) won that particular challenge, subject to confirmation of eligibility and compliance with the Contest rules) and the Finalist(s) who has been eliminated from the Contest on May 7, 2018 prior to the Finalists completion of Final Challenge; based on any lawful criteria they determine in their sole discretion, including but not limited to audience response and overall performance during the competition. The eliminated Finalist(s) will not be eligible to complete in Final Challenge.

 

  1. Final Challenge:
    1. Finalists remaining after Challenge 5 will complete their Final Challenge (see details immediately below) live on stage for Station Judges and audience on May 14, 2018 at around 7:00 p.m. (CT).  THE FINAL CHALLENGE WILL TAKE PLACE AT FUNK’S PUB LOCATED AT 5956 EXECUTIVE DRIVE #101, FITCHBURG, WI 53719.  The exact time remaining Finalists must show up for the Final Challenge will also be announced on-air and online on or about the week of May 7, 2018.
    2. Each remaining Finalist will receive the opportunity to perform up to 30 minutes of their original music at the Final Challenge (only the first thirty (30) minutes of any performance will be judged; however, longer performances will not be disqualified). Finalists also have 15 minutes to set up and sound check from the moment they step onto the stage to the start of their set; after the performance and they receive judging, they will have 5 minutes to clear the stage.
    3. Upon the conclusion of each remaining Finalist’s performance at the Final Challenge, a panel of Station judges will decide which remaining Finalist is the grand prize winner (upon confirmation and verification of eligibility and compliance with these Contest rules), based on any lawful criteria they determine in their sole discretion, including but not limited to audience response and overall performance during the competition (the “Grand Prize Winner”).

 

  1. Rules applicable to all Challenges:
    1. Any failure to attend, timely arrive or failure to stay for the duration of any of the above may result in automatic disqualification of that Finalist.
    2. Each Finalist will have a maximum of twenty (20) minutes to set up, perform competition song, receive judging and break down their equipment.
    3. The Station may from time to time add an additional challenge before the completion of a weekly challenge.  Any additional aspect added to a particular challenge will affect all competing Finalists and will be announced immediately before or during the Challenge.
    4. In one or more weekly challenges the Station may allow Finalists to add additional performers.  Additional performers are not considered contestants of Project M and are not eligible to win this Contest or receive any prize. 
    5. Both the music and lyrics must be original written music by members in Finalists at each Challenge and fully performed by the Finalists. No sampling or recorded music may be included unless the music was wholly created and written by the Finalist and musical performances actually performed by only the Finalist in this Contest.
    6. Songs performed in Challenges must not contain any copyrighted music, video, lyrics or other material unless the Finalist has obtained all of the appropriate licenses for the commercial use of such copyrighted material and has presented proof of such licenses to Station, unless Station provides Finalist with certain copyrighted music in which Station was granted permission to use in conjunction with this Contest for certain Challenges.  Station may determine whether such proof is acceptable in its sole discretion.
    7. Songs performed at Challenges must not contain any indecency, profanity, obscenity, explicit sexuality, or lyrics that are harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, libelous, that encourages unlawful behavior, is hateful, or which is racially, ethnically or otherwise offensive or objectionable, as determined by Station in its sole discretion and may be disqualified by Station on a case-by-case basis. KEEP IT CLEAN.
    8. Songs performed at Challenges must not include brand names, trademarks, trade names, logos or the intellectual property of any third parties, unless otherwise instructed by Station. 
    9. The rules Station announces at the time each Challenge is announced will govern that particular Challenge.  Station Management shall be the sole arbiters in all matters relating to the interpretation of the rules associated with a particular Challenge and their decision shall be final as to all matters.
    10. Failure to adhere to any of the above-rules or any specific rules announced at the time of each Challenge may result in disqualification.
    11. If a Finalist in its entirety cannot continue further in the Contest for any reason (including but not limited to disqualification, irreconcilable break-up, illness, tardiness or failure to appear for a challenge, etc.) then Station reserves the right to eliminate or modify a Challenge based on the reduced number of Finalists. Station may pick an alternate (e.g., a previous week’s eliminated Finalist) to replace the eliminated Finalist. Station judges will select from all previously eliminated Finalists in their sole discretion based on any lawful criteria, including but not limited to overall performance throughout the competition, songwriting ability and overall style.
    12. All Challenges must be performed only by the Finalist (i.e., no other person other than the Entrant selected as a Finalist provides vocals or other persons other than the Entrant selected as a Finalist accompanying another such selected Entrant on an instrument), unless otherwise permitted as part of the criteria for a specific Challenge as announced by the Station.
    13. Station reserves the right to eliminate more than one (1) Finalist during a weekly Challenge depending on the nature of the Challenge.  Station will announce the possibility that more than one (1) Finalist could be eliminated for during the announcement of a particular Challenge.
    14. Station reserves the right to have Challenges announced at optional appearances during the Contest instead of immediately after completion of particular week’s Challenge at the Station’s studios as outlined above.  In the event this occurs, Station will give Finalists at least 48 hours advance notice of the location and time of the optional appearance in which the Challenge will be announced.  Finalists are not required to attend these optional appearances and attendance at these optional appearances will not increase or decrease a Finalist’s chance of winning or being eliminated during a specific Challenge or chance of winning or losing the overall competition.  In the event a Finalist is unable to attend an optional performance, the instructions for the Challenge that were delivered to the other Finalists who attended the appearance will be emailed to the Finalist(s) who were not able to attend at approximately the same time.
    15. Finalists may have the opportunity, from time to time, to perform at additional appearances outside the Weekly Challenges and Final Challenge that Station may make available to the Finalists, as determined in the Station’s sole discretion.  However, the Finalists are not guaranteed any number of appearances to perform at (if any at all) and Finalists are not obligated to perform at such appearances which may become available.  Performing at these additional appearances will not increase or decrease a Finalist’s chance of winning or being eliminated during a specific Challenge or chance of winning or losing the overall competition.  These performances will not be voted on by listeners and will not be judged by Station judges.  In the event a Finalist performs at an appearance that Station has made available, Finalist will receive no compensation for such performance.
    16. Video and audio are recorded live at the Challenges and although Station strives to maintain consistent quality among Finalists there may be varying quality that is beyond Station's control. As a result, if a Finalist request that his or her video and or audio be removed from Station's website, station may try to comply within its reasonable discretion.  In the event a Finalist's video is removed, that Finalist will remain without a video for that particular Challenge(s) and all other Finalists' videos will remain as is, unless otherwise requested by the individual Finalists.

 

Prize:

 

 

  1. The one (1) verified Grand Prize Winner (if any) will receive the one (1) grand prize package in this Contest, consisting of the following:
    1. The Grand Prize Winner will have its song played on Station at least once per day for at least four (4) weeks. Grand Prize Winner must provide Station with their song by June 1, 2018 or this portion of the grand prize will be forfeited.
    2. $1,000 in the aggregate in the form of company checks made out to each Entrant individually (the number of Entrants comprising the Grand Prize Winner will determine the number of checks, which shall either be one (1), two (2), or three (3), which $1,000 shall be evenly divided between the number of Entrants which comprises the Grand Prize Winner). The check(s) will be made available within thirty (30) business days from the date on which Grand Prize Winner completes and provides all required Station documents.
    3. Guitar provided by Ward Brodt at a retail value of $630.  Only one (1) guitar will be given pursuant to this Section, and it is the responsibility of the Entrant to inform Station upon demand which individual Entrant will receive each of the aforementioned, if applicable.
    4. Opportunity for Grand Prize Winner to perform at Summerfest on Friday, July 6, 2018 at 12p on the Harley-Davidson Roadhouse Stage.  Such performance is based on availability and will not be guaranteed.  Date and time slot are subject to change in Station’s sole discretion.
    5. The one (1) verified Grand Prize Winner (if any) will be considered for up to four additional Triple M performance opportunities for the remainder of 2018 to either perform as the primary act or as an opener.  Opportunities are within the discretion of the Station and Station is under no obligation to guarantee any number or opportunities.

Other Rules Specific to this Contest:

 

  1. Entry in this contest is gratis and not in exchange for any airplay, add, increased airplay or rotations for the Entrant(s) or any other artist, except as expressly described herein with respect to the Grand Prize Winner (for which Station will notify the applicable monitoring services and disclose on-air that the playing of the winning song is part of the contest prize).  Notwithstanding the on-air plays specifically identified as part of this contest above (for which Station will notify the applicable monitoring services) or part of the prize as set forth herein, any decision by the Station to play any such music (whether in connection with the Contest or otherwise) will be at the sole discretion of the Station and is in no way implicitly or explicitly in exchange for participation in this contest.  If Station elects to play any such entry submission during or after this contest, Station may identify the entrant as a sponsor.  IN NO EVENT DOES PARTICIPATION IN THIS CONTEST MEAN THAT ANY ENTRANT IS ENTITLED TO ANY AIRPLAY OF THEIR ENTRY SUBMISSION, OTHER THAN AS EXPRESSLY SET FORTH IN THESE CONTEST RULES.

 

  1. WHETHER OR NOT SELECTED AS A FINALIST OR GRAND PRIZE WINNER, ALL ENTRIES AND FINALIST PERFORMANCES AT CHALLENGES MAY BE USED BY STATION IN ANY MEDIUM IT DEEMS DESIRABLE NOW OR IN THE FUTURE WITHOUT ANY COMPENSATION TO THE ENTRANT OR FINALIST (AS APPLICABLE), OR ANY OF THE PERSONS WHO PROVIDE MATERIALS FOR THE SUBMISSION. The original musical works contained in entries or in Finalists’ performances shall remain property of each Entrant or Finalist, but by entering in this Contest, each Entrant grants Station his or her consent to use any entry (including but not limited to the musical performance submitted with an entry) or any Finalist performance at a Challenge, or any part thereof, indefinitely in any advertising, promotion or use of any other kind including, but not limited, to on-air and online usage without any compensation to Entrants or Finalist (as applicable) or any third parties.  The aforementioned stipulations apply to all winning and non-winning Entrants and every Finalist’s performance at a Challenge. 

 

  1. Station is not responsible for any costs associated with submitting any entry or any costs arising out of participating in the contest or failure to adhere to Official Contest Rules.

 

  1. By entering this contest, Entrants acknowledge and agree that Station reserves the right to post some or all of the entries or some or all of the Finalist performances at Challenges on the Station’s website or play some or all of the songs on any of its radio stations.

 

  1. By entering this contest, Entrants understand and agree that Station may elect to use any submitted entry for entertainment purposes on-air and may choose to “make fun” of any submitted entry. Entrants waive any right to make any claim against Station, or any contest sponsors with respect to any disparaging comment made on-air about such Entrant’s entry.

 

  1. Second Street is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to Second Street’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “Second Street Policies”) and may be required to register with Second Street.  While agreement to the Second Street Policies is required in order to enter this contest, the Second Street Policies are not a part of these contest rules but are a separate agreement between the Entrant and Second Street.  With respect to the conduct of this contest by Station, in the event of any conflict between the Second Street Policies and the Station contest rules, the Station’s contest rules govern.

 

  1. Station is not responsible for any error or technical malfunctions associated with the Second Street site that may affect any entrant’s ability to enter, win, or be properly considered in this Contest, regardless of the cause.  In the event of a malfunction associated with the Second Street site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances.  Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.

 

  1. Employees of Second Street and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible to win in this Contest.
